Civil Rights Win for W&B

Warren & Burstein successfully represented a man who was pepper-sprayed by a San Diego County Sheriff’s deputy in front of his house. The civil rights case was filed in federal court in the Southern District of California, alleging excessive force, violation of civil rights, and a due process violation based on false statements in a police report.


The incident was captured in the home-owner’s video security system. After being pepper-sprayed and arrested, our client spent a night in jail. Rather than take the risk of litigation, the County settled for the case, and we recovered over $100,000 for our client.
